line-height: 35px;\" data-fusion-font=\"true\">Conhe\u00e7a as principais altera\u00e7\u00f5es das nova lei dos cons\u00f3rcios n\u00ba 11.795\/08 que entrou em vigor em 06\/02\/09 complementada pela circular 3.432 divulgada em 04\/02\/09 pelo Banco Central do Brasil. Esta nova regulamenta\u00e7\u00e3o agregou v\u00e1rios benef\u00edcios para os consorciados. Seguem abaixo alguns t\u00f3picos das mudan\u00e7as mais relevantes da nova lei:<\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\"><b>Uso da Carta para quita\u00e7\u00e3o de financiamentos<\/b><\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\">Utiliza\u00e7\u00e3o do cr\u00e9dito, ap\u00f3s a contempla\u00e7\u00e3o, para quita\u00e7\u00e3o total de financiamento em nome do pr\u00f3prio consorciado, tanto para o cons\u00f3rcio imobili\u00e1rio, como para o de autom\u00f3vel.<\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\"><b>Uso da Carta de cr\u00e9dito para aquisi\u00e7\u00e3o de im\u00f3vel na planta<\/b><\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\">O Consorciado contemplado, pode adquirir um im\u00f3vel vinculado a empreendimento imobili\u00e1rio, desde que ofere\u00e7a outro im\u00f3vel como garantia e respeite as demais condi\u00e7\u00f5es descritas no Contrato de Ades\u00e3o.<\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\"><b>Saldo do cr\u00e9dito para quita\u00e7\u00e3o de despesas tribut\u00e1rias do bem adquirido <\/b><\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\">Uma grande vantagem para os consorciados, pois a Lei determina que, se o valor do bem for inferior ao valor do cr\u00e9dito, o saldo restante poder\u00e1 ser utilizado para pagamento de despesas tribut\u00e1rias, como transfer\u00eancias de propriedade, tributos, registros cartoriais, institui\u00e7\u00f5es de registros e seguro, desde que o valor dessas despesas n\u00e3o ultrapasse o limite de 10% do valor total de cr\u00e9dito.<\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\"><b>Limite para a compra de cotas<\/b><\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\">Fica limitado em 10%, a quantidade de cotas que um consorciado pode adquirir no mesmo grupo.<\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\"><b>Mais rapidez para constitui\u00e7\u00e3o do grupo<\/b><\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\">Para constituir o grupo n\u00e3o \u00e9 mais necess\u00e1rio aguardar a ades\u00e3o de no m\u00ednimo 70% de participantes. Basta que o grupo possua recursos suficientes para contemplar o bem de maior valor do grupo at\u00e9 a data da 1\u00aa Assembleia Geral Ordin\u00e1ria.<\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\"><b>Restitui\u00e7\u00e3o de valores pagos por consorciados exclu\u00eddos<\/b><\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\">Os consorciados exclu\u00eddos, poder\u00e3o ter seus valores pagos, a t\u00edtulo de fundo comum, restitu\u00eddos sem ter de esperar o encerramento do grupo. Para isso o consorciado concorrer\u00e1 aos sorteios mensais nas assembleias.<\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\"><b>Vig\u00eancia da Lei 11.795\/08<\/b><\/p>\n<p style=\"font-size: 24px; line-height: 35px;\" data-fusion-font=\"true\">A Lei entrou em vigor desde 06\/02\/2009, portanto todos os Grupos formados a partir dessa data est\u00e3o regulamentados pela referida Lei.
